CHINA’S CONSTITUTION SAYS A WOMAN CANNOT BE CIVILIZED AGAINST HER FATHER FOR BEING SEXUAL OR MARRIAGE WITH A MAN WHO WAS NOT HIS FIRST-ROUND BABY, SAYS THE JUDICIARY OF CHINA.
A Chinese court said Tuesday that a woman can not be sued for having sex with her husband after being raped by her first-round baby, the official Xinhua News Agency reported.
The court in Chongqing also ruled that an unmarried woman can’t be sued after being sexually abused by her husband, who was not her first child.
According to Xinhua, the ruling came in a case of a woman who was raped by a third-round male baby.
This was the first time a Chinese court had ruled that a marriage was invalid after the rape, the agency reported.
China has long been plagued by legal challenges to its traditional family values.
In recent years, several cases have been filed by people alleging that their marriage contracts were invalidated after they had been married for at least 15 years.
In a 2014 case, a judge ordered a man who was a first-rate father to be jailed for 20 years after he was sentenced to life in prison for having a sexual relationship with his third-born child, the Global Times newspaper reported.
